1. Scope / General

www.goldandmary.ch / www.goldandmary.com is the online store of nineteen GmbH (hereinafter referred to as nineteen).

The present General Terms and Conditions (GTC) apply to all contracts that nineteen concludes with individuals or companies (hereinafter referred to as the customer) regarding products offered in the online shop of nineteen. By placing an order in the online shop of nineteen, the customer accepts these GTC. The GTC apply in the version that is current at the time of the conclusion of the contract. nineteen reserves the right to change these GTC at any time by publishing them on www.goldandmary.ch.

2. Order & Conclusion of Contract

All orders are placed through www.goldandmary.ch / www.goldandmary.com after the customer has accepted the present terms and conditions. After placing the order, the customer will receive an email as confirmation. With this confirmation of the order, a contract is concluded between the customer and nineteen. nineteen reserves the right to refuse or decline orders. The products on www.goldandmary.ch / www.goldandmary.com are depicted and described as accurately as possible. However, possible deviations from the delivered products cannot be excluded.

3. Prices

The prices published on www.goldandmary.ch / www.goldandmary.com apply, which are stated in Swiss Francs including any applicable value-added tax. The prices are exclusive of shipping costs. The shipping costs will be specified separately during the ordering process and in the order confirmation.

4. Payment

The customer has access to all payment methods available at www.goldandmary.ch / www.goldandmary.com.

5. Shipping of the order or delivery

The delivery of the ordered items is made directly to the person and delivery address specified by the customer. For quality and safety reasons, nineteen strives to deliver the goods, if possible, through Swiss Post. The terms and conditions of Swiss Post apply. nineteen assumes no liability for any delivery delays caused by Swiss Post.

If an ordered product cannot be delivered despite confirmation, the customer will be informed within three working days. The payment made will be refunded to the customer, and there will be no subsequent delivery of the products. Claims for non-delivery or late delivery are excluded. The delivered products remain the property of nineteen until full payment is made.

6. Delivery time and adherence to delivery deadlines

All delivery times announced by nineteen are for orientation purposes only. Non-compliance with delivery deadlines does not result in any entitlement to withdraw from the contract or to claim damages. If nineteen is unable to deliver an order, there is no obligation for nineteen to carry out the delivery in any other way. The customer has no right to claim damages. Partial deliveries are permitted, and any additional shipping costs incurred will be borne by nineteen.

7. Shipping Costs

The shipping costs correspond to the shipping method chosen by the customer and are to be paid by the customer.

8. Cancellation of Delivery

If a successful delivery is not possible or only possible under difficult conditions for reasons not attributable to nineteen, nineteen is free to cancel the order. Any claim by the customer for damages or compensation is fully excluded.

9. Returns & Exchanges

If a product purchased from nineteen does not appeal to the customer, has defects or flaws, the customer must submit a precise description of the issue within 14 days and return the goods in their original packaging. The return of the products is at the customer's expense and risk. Returning products without a request from nineteen will not be accepted and will be sent back to the customer at their expense.

11. Final provisions & Jurisdiction

The contractual relationship, including these GTC, is exclusively governed by Swiss law. Should any parts of these GTC prove to be unenforceable or invalid for any reason, the validity of the remaining provisions shall not be affected.

The place of jurisdiction for all disputes is at the registered office of nineteen. For legal entities, the Commercial Court of St. Gallen is exclusively applicable as the place of jurisdiction.
